What is VAWA?

The Violence Against Women Act, or VAWA, gives abused spouses and children of U.S. citizens or lawful permanent residents who are living in the U.S. a protection by which to “self-petition” for lawful permanent resident status (a U.S. green card). This petition acts as a substitute for the usual process, in which the immigrant must rely on participation by the U.S. spouse or parent. VAWA effectively cuts the abuser out of the process and limits his or her control over the immigrant.

You may petition for immediate relative or family-sponsored immigrant classification for yourself (also known as a self petition) if you:

Have a qualifying relationship with an abusive U.S. citizen or lawful permanent resident;

Are now or were the spouse of an abusive U.S. citizen or lawful permanent resident;

Are the child of an abusive U.S. citizen or lawful permanent resident; or

Are the parent of an abusive U.S. citizen son or daughter who is at least 21 years of age when filing this petition;

Are eligible for immigrant classification based on that relationship;

Are now residing with or have resided with the U.S. citizen or lawful permanent resident abuser in the past;

Have been battered by or have been the subject of extreme cruelty perpetrated by:

Your U.S. citizen or lawful permanent resident spouse during the marriage,

You are the parent of a child who has been battered by or has been the subject of extreme cruelty perpetrated by your abusive U.S. citizen or lawful permanent resident spouse during your marriage;

Your U.S. citizen or lawful permanent resident parent while residing with that parent; or your U.S. citizen son or daughter;

A person of good moral character;

A spouse, and entered into the marriage to the U.S. citizen or lawful permanent resident abuser in good faith.

Note: A VAWA- self-petitioner may be able to have the permanent bar forgiven to them if they can show the connection between the abuse and battery and the re-entry/removal/attempts to re-enter.

EVIDENCE.

You may file your self-petition with any credible relevant evidence of your eligibility. The determination of what evidence is credible and the weight to be given that evidence is within the sole discretion of USCIS; therefore, you are encouraged to provide the following documentation:

declaration describing your relationship with the abuser and the abuse you suffered

police clearance records and/or other evidence to show you are a person of “good moral character”

a copy of your passport or birth certificate

proof that the abuser is a U.S. citizen or green card holder

proof that you are the abuser’s spouse, child, or parent

proof that you lived with the abuser

proof that you suffered abuse

proof that you currently live in the United States.

Note:

You must file a self-petition within two years of the date of the U.S. citizen abuser’s death;

You must file the petition within two years of the U.S. citizen or lawful permanent resident abuser’s loss of status as a result of an incident of domestic violence

You must file the petition within two years of the termination of the marriage to the U.S. citizen or lawful permanent resident abuser if there is a connection between the termination of the marriage and the battery or extreme cruelty.

For self-petitioning spouses, you may remarry after USCIS approves your self-petition without affecting your eligibility to become a lawful permanent resident or have grounds for revocation of the approved self-petition.

Una persona de buen carácter moral;

Un cónyuge y contrajo matrimonio de buena fe con el ciudadano estadounidense o el abusador residente permanente legal.

Nota: Es posible que un auto-peticionario de VAWA pueda obtener el perdón de la prohibición permanente si puede mostrar la conexión entre el abuso y la agresión y el reingreso / remoción / intentos de reingreso.

EVIDENCIA

Puede presentar su auto-petición con cualquier evidencia relevante creíble de su elegibilidad. La determinación de qué evidencia es creíble y el peso que se le debe dar a esa evidencia está dentro del exclusivo criterio de USCIS; por lo tanto, le recomendamos que proporcione la siguiente documentación:

Nota:

Debe presentar una auto-petición dentro de los dos años posteriores a la fecha de la muerte del abusador ciudadano estadounidense;

Debe presentar la petición dentro de los dos años posteriores a la pérdida de estatus del abusador ciudadano estadounidense o residente permanente legal como resultado de un incidente de violencia doméstica.

Debe presentar la petición dentro de los dos años posteriores a la terminación del matrimonio con el ciudadano estadounidense o el abusador residente permanente legal si existe una conexión entre la terminación del matrimonio y la agresión o crueldad extrema.

En el caso de los cónyuges que presenten una auto-petición, puede volver a casarse después de que USCIS apruebe su auto-petición sin afectar su elegibilidad para convertirse en residente permanente legal o tener motivos para revocar la auto-petición aprobada.
